3. Clarification of Course Content and Delivery

3.2 Course Completion and Reporting

ADHI Schools will report course completion to the California Department of Real Estate as required. However, ADHI Schools is not responsible for any delays or errors caused by the user (e.g., incorrect information provided) or the Department of Real Estate’s systems.

4. Disclaimer of Warranties

ADHI Schools does not guarantee that the information provided on the websites will be accurate or updated. User agrees to indemnify and hold harmless, and at ADHI Schools’ request, defend ADHI Schools and their respective affiliates, agents, and employees from and against any and all claims, actions, demands, liabilities, losses, damages, judgments, penalties, settlements, costs, and expenses (including reasonable attorney’s fees and costs — hereinafter referred to as “Losses”) insofar as such Losses (or actions in respect thereof) arise out of, are based on, or relate to:

2. Any misrepresentation of any information, representation, or warranty, or breach of this Terms of Use or any other covenant or agreement.

This Agreement shall not be governed by the United Nations Conventions of Contracts for the International Sale of Goods, the application of which is hereby expressly excluded from any interpretation of this Agreement.

Users who initiate credit card chargebacks without first contacting ADHI Schools to resolve the issue may be subject to suspension or termination of their account and potential legal action if the chargeback is deemed fraudulent.

13. Course Approval from the Department of Real Estate

Our courses are approved by the California Department of Real Estate.

14. Errors or Omissions in the Textbook

ADHI Schools believes that the materials are published and written in good faith. ADHI Schools is not responsible and will accept no responsibility for errata in any of the textbooks, review materials, or study aids provided or sold to the student.

15. Independent Investigation

ADHI Schools reserves the right to investigate suspected violations of the terms and conditions of this Agreement whenever ADHI Schools becomes aware of possible violations. Such an investigation may include gathering information from the user and the complaining party and reviewing materials on ADHI Schools’ servers. During an investigation, ADHI Schools may remove any and all disputed material from ADHI Schools’ servers.

16. Amendments

17. Acts of God

18. Waiver

ADHI Schools’ failure to enforce strict performance of any provision of this Terms of Use will not constitute a waiver of ADHI Schools’ right to subsequently enforce such a provision or any other provision of this Agreement, nor will any delay or omission on the part of ADHI Schools to exercise or take advantage of any right or remedy that ADHI Schools has or may have hereunder, operate as a waiver of any right or remedy.

19. Severability

20. Headings

The division of this Agreement into sections and the use of headings are for convenience of reference only and shall not modify or affect the interpretation or construction of this Agreement or any provision hereof.

21. Merger Clause

This Agreement constitutes the entire agreement between you and ADHI Schools concerning the subject matter contained herein and supersedes all prior or contemporaneous representations, proposals, conditions,communications, and agreements, whether oral or written, between the parties relating to the subject matter herein and all past courses of dealing or industry custom. The subject matter herein may not be modified except by ADHI Schools.

22. No Legal Advice Given

Throughout this course you will learn about various aspects of real estate. It is the intention of the course and the firm to provide each student with up-to-date, timely, and accurate information.
